In a significant legal triumph for the family of former Starehe MP Gerishon Kirima, a recent ruling by Environment and Land Court judge Samson Okong’o has favored the Kirima family in their ongoing battle with squatters who occupied a vast 1,000-acre parcel of land in Nairobi’s Njiru area. The court has ordered the squatters, numbering in the hundreds, to vacate the area by December 31 or face eviction.
This victory comes after a prolonged legal struggle that dates back to 2003 when illegal settlers began encroaching upon the Kirima family’s land. The squatters, organized into three distinct groups, claimed entitlement to the land through adverse possession, arguing that they had lived there continuously for over 12 years. However, Judge Okong’o dismissed their claims, stating that they had entered the land without legal authorization and had constructed houses without the owner’s consent.
Judge Okong’o’s ruling declared the squatters as trespassers, emphasizing that they lacked a legal basis for their occupation. Furthermore, the judge revealed that another group of individuals had legitimately purchased the land from the late Kirima before his passing, underscoring the complexity of the dispute.
