Environment CS Soipan Tuya has taken a bold step in seeking legal recourse against her estranged husband, filing a case at the Nairobi Children’s Court. In her plea, Tuya demands custody of their two children and a total of Sh3.1 million annually for their upkeep, citing a history of psychological, emotional, and verbal abuse at the hands of her estranged spouse.
Tuya’s court documents reveal a distressing account of the alleged abuse endured by her and her children, as well as her domestic workers, describing an atmosphere of fear and intimidation in her own home. According to Tuya, her husband’s abusive behavior has driven her to live in constant fear for their lives, compelling her to seek full custody of the minors.
The legal action involves a detailed breakdown of financial support she seeks, including Sh675,000 annually for the children’s school fees and Sh1.2 million yearly for their entertainment needs. Additionally, she demands Sh1.2 million annually for the children’s general maintenance. The total sum sought amounts to Sh3.075 million.
The court documents also reveal the timeline of their relationship, starting from December 2013 and ending in December 2020 when the husband moved out to live with his other wife. Despite serving him with court papers in July, Tuya claims her estranged husband has not responded to the case and continues to neglect his responsibilities, leaving her as the sole provider for their children.
Tuya’s plea paints a harrowing picture of a relationship marred by neglect, abuse, and threats. She asserts that her estranged husband not only failed to contribute financially but also denied paternity of the children, demanding a DNA test to establish his biological connection to them.
In her pursuit of justice, Tuya implores the court to expedite the proceedings, emphasizing the urgency of the matter. Through her courageous stand, she highlights the importance of standing up against abuse and fighting for the well-being of her children.
